Possibly. I can certainly see apps that require CALL_PHONE on the
Market with a Nexus One running 2.2:
-- Advanced Call Manager
-- recordAcall
-- QuickCall
-- Big Call
-- etc.
(note: I am not recommending any of these, I am merely pointing out
that they are visible to me on the Market and use CALL_PHONE)
